Terms & Conditions

 

By booking an in-person or online class, private session or event with Nichola Day  Yoga you are entering into a contract which has the following conditions. Please read through them carefully.

Block bookings for regular, in-person classes: By booking a block of classes you are receiving the benefit of a confirmed place in that particular class. If you are unable to make any of the block, your booking cannot be extended, swapped to another class or refunded. At the time of booking, you will be asked to complete a health waiver form. By completing this you are agreeing to take take part in classes at your own risk and to consider any modifications suggested by the teacher if relevant to you. You are also agreeing to update the teacher if you acquire any new injuries, illnesses, surgeries, pregnancies or conditions. 

 

**COVID-19 Addition - In the event of restrictions being tightened and larger in-person gatherings  being restricted, by booking you are also agreeing to attend your booked time slot online, via zoom as an alternative.

One-to-one/Yoga Therapy sessions: Payment is due at the time of booking for the whole agreed block of sessions (6, 8, 10 or 12), which must be at least 48 hours prior to the first booked session. The cancellation period is 24 hours given in writing (email to nicholadayyoga@gmail.com). If less than 24 hour notice is given the session is charged as taken. If a session is cancelled with 24 hours notice,  it can be rearranged for another mutually convenient time. When purchasing a block of one-to-one/yoga therapy sessions, the whole course must be taken within the following time periods: 6 session block - 4 months, 8 session block - 5 months, 10 session block - 6 months, 12 session block - 8 months. At the time of booking, you will be asked to complete a health waiver form. By completing this you are agreeing to take take part in classes at your own risk and to consider any modifications suggested by the teacher if relevant to you. You are also agreeing to update the teacher if you acquire any new injuries, illnesses, surgeries, pregnancies or conditions.

**COVID-19 Addition - In the event of restrictions being tightened and in-person meetings being restricted, by booking you are also agreeing to attend your booked time slot online, via zoom as an alternative.

Cancellation: in the event of a cancellation, credit will not be held unless it is at the discretion of Nichola Day and the credit must be used within 3 months.

Online Classes: After booking an online class, if you are unable to make the agreed session(s) that booking cannot be extended, swapped or refunded. At the time of booking, you will be asked to complete a health waiver form. By completing this you are agreeing to take take part in classes at your own risk and to consider any modifications suggested by the teacher if relevant to you. You are also agreeing to update the teacher if you acquire any new injuries, illnesses, surgeries, pregnancies or conditions.

Workshops and Day Events: For events that are a 2 days or less, then full payment is required at time of booking to secure your place. If you cancel with more than 28 days notice in writing then full payment less than £10 admin fee will be given. Cancellation between 28 and 14 days, 50% refund will be given. Cancellation less than 14 days – no refund, credit or alternative will be given. You may be able to send a substitute in your place, but only if this is first agreed by Nichola Day Yoga.

Retreat Weekends: A deposit of £125 is required to book your place. This is non-refundable. Cancellation is required in writing. Cancellation of more than 60 days – Full refund of monies paid (less deposit).  Cancellation of 60 days or less, no refund, credit or exchange. Any outstanding monies are that have yet to be paid, are still legally due even in the the event of cancellation that is 60 days or less before the start date of the event.

 

Cancellation of Event 

It is expected that participants to events will have adequate personal insurance to cover all eventualities that might occur.

If Nichola Day Yoga chooses to cancel an event then all monies paid to Nichola Day Yoga will be refunded. In this circumstance Nichola Day Yoga will not be liable for any other expenses incurred by the participant, including but not limited to travel costs, insurance costs, etc.

Nichola Day Yoga reserves the right to send a substitute teacher in the place of a named teacher if unexpected circumstances preventing the named teacher from teaching on any event.

In the event of Force Majeure/unforeseen circumstances that hinders, delays, or leads to cancellation of any events, Nichola Day Yoga will not be liable for any costs incurred or to repay any monies received. Participants will be expected to claim under their individual insurance. This includes but is not limited to, severe weather, acts of terrorism, disease epidemics, government actions, natural disasters, war, strikes, and failure of 3rd parties such as venues/caterers to provide their services.

In registering for any event or service you agree to assume all risks associated with the event and/or service and agree that no liability will be attached to Nichola Day Yoga (or any staff member or contractors working on behalf of Nichola Day Yoga) for any personal injury, illness, delay, loss or damages to property, finances or health.
